How to Resolve a Contract Dispute: A Guide for Entrepreneurs

Even when doing business in good faith, there will be times when things end in a contract dispute. If you’ve never encountered a dispute before, you might be wondering what you need to do to resolve the issue promptly.

Review the Original Contract

The first thing you need to do when figuring out how to resolve a contract dispute is to go over the contract. Doing this gives you a chance to look back on what both parties agreed upon before moving forward with settling the dispute.

It’s also useful to collect the other forms of contact sent between parties that might mention things like price, deadlines, and more. Some contracts include a dispute clause that outlines what will happen if a dispute resolution must be decided upon.

Seek Mediation

If you’ve done your best to settle the dispute with your contractor, but aren’t coming to an agreement, it’s time to seek mediation. Mediation can help because an unbiased third party will enter the conversation and help you to come to an agreement.

Once both parties have come to an agreement, the next step will be to take what was agreed upon and put them into written form. Once it’s been put into a written form, both parties should sign it and are provided a signed copy for your records.

Settle It In Court

If all else fails, one thing that you might need to do is takes things to court. In most cases, settling a dispute in court will be the last thing on everyone’s mind because that means taking more time and money to settle a dispute that might not need to be taken to court.

Its recommended that although you don’t need a lawyer during a dispute resolution case, you still have one. They will understand the laws in your area and at the least advise you of the steps you need to take to ensure the best outcome in your case.

Seek Arbitration

Arbitration is similar to that of meditation. The main difference in arbitration is that the decision both parties agree upon will bind them legally.
