DC Circuit, en banc, DENIES Flynn’s request for emergency relief.

Reports reaching The News God indicates DC Circuit, en banc, DENIES Flynn’s request for emergency relief.

People on social media have taken up a celebration by stating that “this is the most normal thing to happen in Flynn’s case for a long, long time. Count it as a win for the rule of law & a loss for Barr’s politicization of DOJ, which supported Flynn here”

The court on the following reasons denied Flynn’s requests by saying No to:

  1. Forcing the district court to approve immediately dismissing the charges against Flynn
  2. Rejecting the district court’s appointment of an amicus
  3. Reassigning the case to a different district judge.

On an 8-2 ruling on Monday by the D.C. Circuit Court of Appeals denied the former national security adviser Michael Flynn’s petition to force a federal judge to immediately drop his criminal case, as requested by the Justice Department.

Why it matters: The ruling will allow District Judge Emmet Sullivan to hold hearings to discuss the motion to dismiss the case against Flynn, who pleaded guilty in the Mueller investigation to lying to the FBI about his contacts with the former Russian ambassador.
